These Terms of Service govern access to and purchases made through www.nevalabs.com.

Throughout these Terms, "NEVA", "we", "our" and "us" refer to the seller identified below.

The customer's sales contract is entered into with the legal seller identified above.

Manufacturers, suppliers, fulfilment centres and shipping carriers used by NEVA do not replace NEVA as the customer's contractual seller.

2. Eligibility

By placing an order, customers confirm that they have the legal capacity to enter into a binding contract or have appropriate authorisation from a parent or legal guardian where required.

3. Products

NEVA sells products and accessories primarily related to skiing, snowboarding, outdoor activities and related technology.

Product characteristics, specifications and included accessories are shown on the relevant product page.

Customers should review product descriptions carefully before purchasing.

4. Camera-Equipped Products

Certain NEVA products may incorporate camera or recording functionality.

Customers are responsible for using recording equipment in compliance with:

• Privacy legislation.

• Image and personality rights.

• Applicable recording laws.

• Rules imposed by ski resorts or other venues.

• Safety requirements.

The user should not operate or adjust recording functions in a manner that creates a safety risk while skiing, snowboarding or carrying out another activity.

5. Prices

Prices displayed at checkout are those applicable at the time the order is placed.

Applicable VAT or other taxes will be handled in accordance with the destination and applicable legislation.

Any mandatory delivery charges or other charges payable by the customer will be disclosed before completion of the order where required.

6. Orders

After placing an order, customers should receive an electronic order confirmation.

Receipt of an automated confirmation does not prevent NEVA from cancelling an order in exceptional circumstances such as:

• An obvious pricing error.

• Suspected fraud.

• Product unavailability.

• Technical errors preventing fulfilment.

• Legal restrictions on supplying the product.

If NEVA cancels an order that has already been paid, the amount paid for the cancelled products will be refunded.

7. Payment

Accepted payment methods:

Payment is due when the order is placed unless another payment arrangement is explicitly offered during checkout.

Payment processing may be carried out by third-party payment providers.

8. Delivery

Orders are delivered in accordance with the Shipping Policy published below.

Estimated delivery times do not remove any mandatory rights available to consumers under applicable law.

9. Right of Withdrawal

Where applicable, consumers purchasing online have the right to withdraw from the purchase without giving a reason within 14 calendar days from the date on which the consumer, or a third party nominated by the consumer other than the carrier, takes physical possession of the goods.

Where multiple items from a single order are delivered separately, the withdrawal period normally begins when the final item is received.

10. Legal Guarantee

Products are covered by the statutory conformity guarantee required by applicable consumer protection legislation.

For consumers in Spain, new goods are generally covered for lack of conformity that becomes apparent within three years from delivery, in accordance with applicable Spanish consumer legislation.

This statutory guarantee is separate from the 14-day right of withdrawal.

Nothing in these Terms reduces any mandatory statutory guarantee rights.

11. Defective or Incorrect Products

If an item is:

• Defective.

• Damaged.

• Incorrect.

• Missing essential components.

• Otherwise not in conformity with the contract.

NEVA may request photographs, videos or other reasonable information to assess the issue.

Requests for evidence will not be used to improperly restrict statutory consumer rights.

12. Promotions and Discount Codes

Promotional codes may be subject to additional terms displayed at the time of the promotion.

Unless expressly stated otherwise:

• Promotional codes cannot be exchanged for cash.

• Only one promotional code may be used per order.

• Codes may have an expiry date.

• Promotions may be limited to selected products.

Promotions will not affect statutory consumer rights.

13. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

In particular, these Terms do not limit mandatory rights relating to:

• Consumer protection.

• Defective or non-conforming goods.

• Fraud.

• Personal injury where liability cannot legally be excluded.

14. Force Majeure

NEVA will not be responsible for delay caused by events outside its reasonable control, including significant transport disruptions, natural disasters, industrial disputes, customs disruption or similar extraordinary circumstances.

This clause does not remove any rights that consumers have under mandatory law where an order is not delivered.

15. Changes to These Terms

We may update these Terms from time to time.

Changes will not retrospectively alter the contractual terms applicable to orders already placed unless required by law.

16. Governing Law

These Terms are governed by applicable Spanish law.

Consumers residing elsewhere in the European Union retain any mandatory consumer protection rights provided by the laws applicable to them.
